Child Support Agreements and Orders
Child support family law may be sought under the Child Support (Assessment) Act 1989 (Cth). If it is, then the amount of child support payable is calculated using a formula set out in the Act. This represents the amount that the parent who has the primary care of the child or children is entitled to receive from the other parent. The other parent is liable to pay this amount on a monthly basis.
Alternatively, parents may choose to enter into a child support agreement. There are two types of child support family law agreements that may entered into. Limited child support agreements operate for a limited period. The amount of child support payable under a limited child support agreement must be greater than or equal to the calculated amount. Binding child support agreements, on the other hand, are not subject to this requirement.
